Q Can one attorney lawfully hold the position of part-time public defender in circuit court and youth court judge in the same county?

A A part-time public defender does not hold sufficient governmental powers so as to give rise to a possible violation of the separation of powers doctrine. You may wish to consult with the Mississippi Ethics Commission with regard to any issues that may arise under the conflict of interest provisions of Section 25-4-101 et seq., the Commission on Judicial Performance with regard to the Code of Judicial Conduct, and the Mississippi Bar regarding the Rules of Professional Conduct.
