Q May the county permit a local homeowners association to install and maintain, at its expense, a pressure-activated access gate (opening for any vehicle that comes to a stop on an adjoining pressure pad) across a county road leading into a subdivision?

A Section 65-7-7 provides that public roads shall be free of any obstruction. The board may allow a homeowners association to install and maintain such an access gate, provided the gate allows public access at all times to the county road into the subdivision.
