A Both positions are in the executive branch of government, so serving in them simultaneously would not violate the separation of powers doctrine. Caution must be taken to ensure that when the officer is acting as police sergeant, the officer is acting exclusively for the police department and being paid as such, and when acting as constable the officer must be exclusively acting as such and be paid as such.
