Q May a municipality enact an ordinance which assesses criminal penalties and fines for false alarms for private alarm systems in homes and businesses?

A A municipal ordinance may impose a criminal fine for repeated false alarms of homes and businesses and may set the amount of the criminal penalty for the ordinance violation, subject to the limitations set forth in Section 21-13-1 (a fine not exceeding one thousand dollars ($1,000) or imprisonment not exceeding ninety (90) days, or both). Any actual assessment or levy of the criminal penalty would be imposed by the municipal court, upon a finding of a violation of the municipal ordinance.
