Q When a felony prisoner, arrested by municipal police and incarcerated in the county jail, is injured and requires medical treatment, who is responsible for the expense of medical treatment?

A The medical bills are the responsibility of the inmate first. If he is indigent or unable to pay and the treatment or procedure occurred while a municipal prisoner, the city would be responsible. If the treatment or procedure giving rise to the bill occurred after the prisoner was bound over to the grand jury, the county would be responsible. The date of the medical treatment and not the date of the injury controls. (Attorney Generalís Opinion to Whitlock dated April 1, 2011)
