Q Is there any legal process or authority that allows the citizens of a county to petition for a vote that changes the office of superintendent of a consolidated school district to be an elected position as opposed to its current status as an appointed position?

A No authority provides for a referendum on the question of whether to change the position of a superintendent of a consolidated school district from appointive to elective. Furthermore, no legal process exists for the position of appointed superintendent of a consolidated school district to become elective. (Attorney General’s Opinion to Akins dated September 17, 2010)
