Q Must the stepfather of a supervisor waive all compensation, including travel expenses or other expenses, to avoid a violation of the nepotism statute, set forth in Section 25-1-53, if the board of supervisors appoints him to the board of the county correctional authority?

A Yes. In order for the contemplated appointment to avoid the prohibition of the nepotism statute, in addition to receiving no salary, the potential board member in question must waive reimbursement for travel expenses and all other expenses normally afforded board members.
