Q Where are the fees for petitions to expunge authorized by House Bill 1758 (2010 Regular Session) to be settled?
A A filing fee of $150 is levied upon each petition to expunge a conviction under Section 99-19-71. Of the $150, $100 is deposited to the Judicial System Operation Fund, $40 to the District Attorneys Operating Fund and $10 is to be retained by the Circuit Clerk. The Judicial System Operation Fund and the District Attorneys Operating Fund are both special funds in the State Treasury, so these funds should be settled to the State. No monies from this fee should be settled to the local District Attorney’s office.
