Q Senate Bill 2610 provided for salary supplements for district attorneys, legal assistants and criminal investigators in the amounts of $8,300, $6,000 and $5,000 respectively, to be funded by sources other than the state treasury. Are the amounts normally matched by the employer on this income, such as FICA and retirement, to be deducted from the employee’s income or should they be paid by the employer to the proper agencies in addition to the salary amounts?
A The employer may pay the maximum salary amount authorized in Senate Bill 2610, plus any required employer matching amounts, from any available funds. (Attorney General’s Opinion to Wood dated August 6, 2010)
