Q May a municipality award a nonpublic safety employee compensatory time when his or her regularly scheduled day off falls on a scheduled municipal holiday?
A No. A municipal governing authority may not award an employee additional compensation if that employee’s normal day off falls on a holiday. Compensatory time may only be given for work performed on a “legal holiday,” provided that the municipality has adopted a policy for such at the time the work was performed.
