Q According to the Uniform Rules of Procedure for Justice Court, should a case be set on the docket when there has been no officer’s return; the office has not executed the warrant?
A Yes. A general docket would contain every filing or proceeding regardless of the officer’s return. If the court maintains a trial docket, it would generally only contain cases in which process was returned as served and ready for trial. (Attorney General’s Opinion to Roberts dated July 2, 2010)
