Q After making an official finding that a vehicle is surplus property, may the county emergency communications commission (E-911) convey or assign the vehicle to the county to be placed in the county general use vehicle fleet?

A A board of commissioners only has the authority which has been specifically granted to it. The board of commissioners for an E-911 district has no authority to hold real or personal property. The only statutory authority to acquire and hold property under the E-911 scheme rests with the board of supervisors. Therefore, this property belongs to the county. For this reason, the vehicle may be declared surplus and assigned to the board of supervisors for placement in the general fleet. (Attorney General’s Opinion to Long dated June 10, 2010)
