Q May a municipal board offer some type of amnesty or partial suspension of fines which have been assessed to encourage defendants to come in and pay?

A The board lacks the authority to grant a discount on outstanding fines, as this would constitute an illegal donation. A municipal judge, however, may suspend a portion of the sentence (fine) on such terms as may be imposed by the municipal judge pursuant to the terms of Section 21-23-7(5). This allows the judge may enter a blanket order authorizing partial suspension of fines. (Attorney Generalís Opinion to Barton dated March 19, 2010)
