Q May an alderman vote to approve the payment of claims for fuel purchases which will not benefit his employer but may benefit a related company?

A Based upon the particular facts, an alderman will not have a prohibited interest in the fuel purchases as proscribed in Constitution Section 109 and Section 25-4-105(2). Nor will the alderman’s employer be a vendor to the city as prohibited in Section 25-4-105(3)(a). Moreover, the alderman’s employer will not receive a pecuniary benefit as restricted under Section 25-4-105(1). Nevertheless, the alderman should recuse himself from approval of fuel claims to avoid any appearance of impropriety. (Mississippi Ethics Opinion No. 09-092-E dated October 9, 2009)
