Q Must a nonresident bidder be disqualified for failure to submit a copy of the bidder’s resident state’s current law pertaining to such state’s treatment of nonresident contractors?
A The failure of a nonresident bidder to include a copy of the bidder’s resident state’s current preference law with its bid does not require rejection of the bid. However, if the nonresident bidder fails to submit a copy of the law, or a written statement that no such law exists, then the bid must be rejected.
