Default Authority to mow grass and maintain streets and rights-of-way on property jointly owned by the county and the city.

Q Does a county have authority to mow grass and maintain streets and rights-of-way on property jointly owned by the county and the city, with or without an interlocal agreement?

A Yes. Although an interlocal agreement is not required, it is recommended that respective responsibilities of the county and city be evidenced by some form of written agreement or memorandum. (Attorney Generalís Opinion to Chiles dated November 6, 2009)
