Q Does a municipality have the authority to pay a firefighter for a holiday that falls on his normal day off? If so, how many hours may the firefighter be paid for if their normal work schedule consists of 24 hours?

A A municipality must enact leave policies to ensure that its public safety employees are paid or granted leave time for the same number of holidays as other municipal employees. The determination as to what number of hours constitutes a normal work day is a factual determination to be made by the governing authority. (Attorney General’s Opinion to Garcia dated July 31, 2009)
