Q: How many days may a person be incarcerated for failure to pay a fine?

A: A person may not be incarcerated for failing to pay a fine if he or she is an indigent and unable to pay the fine. Pursuant to Section 99-19-20, a person who is financially able to pay the fine may be incarcerated not to exceed one day for each $25.00 of the fine. However, the person would still be liable for the entire fine once released. If a person chose to work, his or her fine would be reduced by $10.00 per day under Section 47-1-47.
