Q Are there any circumstances which would allow for an exception to the general rule that a public school district may not make donations of any kind, to include the assistance with the production of programs for a community event requested by the Biloxi Branch of the NAACP; and does the school district have the authority to allow the Biloxi Branch of the NAACP to use a school districtís choir risers for a community event?

A Activity funds, or other available school district funds, other than minimum education program funds, may only be expended for commodities or school supplies to print programs for a community event upon a finding by the school board that the expenditure is beneficial to the official or extracurricular programs for the district. There is no authority for the school district to allow an organization to use the schoolís personal property for a community event. (Attorney Generalís Opinion to Donovan dated May 8, 2009)
