Q: When an individual comes in to fill out paperwork seeking a protective order against another individual and the defendant has to be served with the summons to appear in court to defend himself how is payment collected for the service fee?

A: There is no fee collected at the time of the filing of the petition for the protective order. At the conclusion of the case, the court may order one party to pay court costs, including service fees pursuant to Section 93-21-7(2). (Attorney General's Opinion to Fuller dated December 19, 2008)
