Q The school district opened bids for certain sixteenth section land leases, and awarded the bid to an individual, who entered into a lease agreement with the district. The individual now seeks to substitute his corporation as the lessee under the lease agreement. Would such a substitution violate Section 29-3-81 or applicable bidding laws?
A Section 29-3-69 governs assignment of a lease of sixteenth section land. This provides that subleasing or assignment shall only be allowed when provided in the lease contract or at the discretion of the board of education (Attorney General’s Opinion to Frieson, September 6, 2019)
