Q The city allows private events on city property (such as a pavilion or community center) for a fee. May the city allow and charge for use of city equipment incidental to the facility rental, such as tables and chairs for a meeting or reception at a community center?

A A municipality may only use municipal equipment and/or personnel for proper municipal purposes and may not engage in private enterprise. However, it is this office’s opinion that municipal equipment and/or personnel may be used by private persons or organizations, provided the use is incidental to the lawful rental of city-owned property.
