Q Section 63-7-301 makes it clear that the driver of a vehicle is responsible for making sure that each child in the vehicle is being transported in compliance with the child restraint requirements. If there is more than one child in the vehicle in violation of the statute, may an officer issue multiple citations or only one?

A A law enforcement officer may issue multiple citations for each violation of Section 63-7-301 (child restraints) occurring in the same vehicle. Conversely, Section 63-2-7, which deals with seatbelt violations of the operator and passengers, only allows for one twenty-five dollar ($25.00) fine whether the operator or multiple passengers are violating the seat belt law.
