Q Our municipality’s municipal court clerk’s office is located in the police department. Should the police chief have supervisory control over the court clerk or should the city clerk supervise the court clerk?

A Section 21-23-11 expressly grants supervisory authority over the municipal court clerk to the municipal judge. The municipal governing authorities may monitor human resource functions such as employee attendance, vacation and other absences, job performance, employment discipline and promotion, job training, financial responsibilities, and maintenance of detailed reporting information necessary to remit for audit purposes.
