Q Is it mandatory for an officer writing a ticket for DUI to check the box for 1st, 2nd, or 3rd/subsequent offense or to write in prior DUI convictions on the citation? Would failure to do so require dismissal of the charge?

A There is no requirement for the officer to check boxes indicating previous DUIs on the ticket or to write in prior convictions. Whether the failure to do so would be sufficient to grant a motion for directed acquittal is a question of fact on which the Office of Attorney General may not opine.
