Q May a county perform gravel work on a private driveway to facilitate the pick-up and drop off of a student by the county mental health service?

A Unfortunately, no. There are limited circumstances under which a county is authorized to expend public funds to improve and maintain a private road or driveway. Section 19-3-42 provides authority for supervisors to maintain driveways used as school bus turnarounds and further authorizes the board to maintain driveways to private, nonprofit cemeteries as well as driveways for certain nonprofit organizations whose primary purpose is drug rehabilitation and which are tax exempt. Unfortunately, state law does not authorize the expenditure of public funds to improve a private driveway utilized by a county mental health service bus carrier for pick-up and drop off of attendees.
