Q May a police officer sign an affidavit on a misdemeanor case without seeing the offense occur?

A Yes, an officer may file an affidavit without actually seeing the misdemeanor occur. The officer (or anyone else) may file a criminal affidavit. It is then up to the judge to determine if there was probable cause to believe that the defendant committed the offense alleged in the affidavit. The Mississippi Rules of Criminal Procedure 2.2 (a) and (b) discuss the affidavit and the finding of probable cause before issuing a warrant. (Attorney Generalís Opinion to Barton, March 30, 2018)
