Q May a defendant previously a granted nonadjudication for a crime other than a DUI receive a nonadjudication for a DUI?

A A nonadjudication pursuant to Section 99-15-26 for a crime other than a DUI offense does not disqualify a person from receiving a nonadjudication pursuant to Section 63-11-30(14). The “one time” limitation found in Section 63-11-30(14) (b) applies only to a prior nonadjudication. (Attorney General’s Opinion to Delgado, November 6, 2017)
