Q May a justice court judge also serve as a municipal court judge?

A Because both positions are in the judicial branch of government, a person can serve in both positions at the same time without violating the separation of powers doctrine. Obviously, he/she would have to keep the positions separate. This office has repeatedly opined, “That a public employee cannot lawfully be paid by two public entities for the same hours worked . . .” As to the question of any ethical issues or conflicts, please contact the Mississippi Ethics Commission.
