Q Does an alderman in a code charter municipality have to resign his position to run for office as a chancery court judge?

A The separation of powers doctrine does not prohibit an alderman from running for chancery judge, but upon election, he would immediately vacate the office of alderman upon assuming the duties of chancellor. We refer you to the Commission on Judicial Performance for any potential issues related to the Code of Judicial Conduct and to the Mississippi Bar concerning any potential issues under the Rules of Professional Conduct.
