Q May a county and city enter into an agreement for the county to house municipal inmates which agreement includes a provision for the city to be responsible for the costs of medical care and/or housing of municipal inmates after they are bound over to the grand jury?

A No, the cost of housing and providing medical care for inmates remain with the municipality until such time as the inmate is bound over to the grand jury. Once a municipal inmate is bound over to the grand jury, the municipal inmate is considered the responsibility of the county. (Attorney General’s Opinion to Nowak, April 15, 2016)
