Q May an economic development district donate real property to a municipality?

A No, Section 66 of the Mississippi Constitution of 1890 forbids any public entity from granting a donation or gratuity except as allowed by a statute passed by a two-thirds majority of each branch of the Legislature. The constitutional prohibition applies regardless of whether the donee is a private entity or another public entity or subdivision. The economic development district has no authority to donate property to a private industry under Section 19-599 and the statute should not be read any differently where the proposed donation is to another political subdivision.
