Q May a limited liability company (LLC) applies for and receive a Homestead Exemption?

A No, Section 27-33-3 requires “homes legally assessed on the land roll, owned and actually occupied as a home by bona fide residents of this state, who are heads of families, shall be exempt…” Section 27-33-13 then defines “head of a family” as a “natural person.” The Mississippi Administrative Code sums up the requirements as “A person requesting homestead exemption must make a written application, must be a natural person, the head of a family, have ownership and eligible property, occupy the dwelling as a home, and be a Mississippi resident.” (Attorney General’s Opinion to Chiles, April 15, 2016)
