Q May the salaries of the District Attorney, Assistant District Attorneys, and the District Attorney’s Criminal Investigator be supplemented with funds collected by the District Attorney’s office from bad check collection, pretrial intervention, or forfeitures?

A Yes, Section 97-19-77(1) authorizes funds collected by the bad/worthless check unit to be used for “any law enforcement purpose,” which includes supplementing salaries. Section 99-15-21 puts no limitation on how the District Attorney’s office may spend pretrial diversion funds once they are paid by the offender, and the manner in which such funds are expended by the District Attorney are left up to him or her. Pursuant to Section 41-29-181, drug forfeiture funds also must be used for “any law enforcement purpose.” (Attorney General’s Opinion to Duncan, January 29, 2016)
