    Default May a municipal judge sentence defendants as habitual offenders?

    Q Does a municipal judge have the discretion to sentence defendants that violate the municipal work program and/or contempt of court for failure to pay back fines as habitual offenders?

    A A municipal court does not have the authority to sentence a defendant as an habitual offender. (Attorney General’s Opinion to Johnson dated May 29, 2009)
