Q May a school board reclassify leases on sixteenth section lands as residential, despite some of the tenants not residing on the property year-round?

A Section 29-3-39 governs classification of sixteenth section land purchased in the Choctaw Purchase and requires a factual inquiry. Reclassification is necessitated by “changes of condition.” Section 29-3-31 delineates the types of classifications and requires a factual determination of the highest and best use for such lands.
