Q May municipalities pay for gym memberships for employees of its fire and rescue department and allow the fire and rescue employees to utilize the gym during work hours?

A Local governing authorities may contract with a local health club or fitness center for the use of its facilities by municipal employees, but governing authorities are prohibited from paying individual membership dues. Instead, the local governing authorities may contract for a fixed fee with a fitness or health club for use of the club by its employees. If the municipality should determine that the time employees use the fitness center is consistent with the employees’ job description and constitutes actual “work”, it may require or permit its employees to exercise during working hours.
