Q May a county perform demolition work on school property for compensation?

A Yes, Section 21-19-49 permits governing authorities of municipalities or board of supervisors of any county to appropriate money or dedicate and convey property to the school district(s) located within the municipality or county for the purpose of erecting, purchasing, or providing the building or site for a school building. When taken in combination with prior opinions allowing in-kind donations where monetary donations are permitted, counties may perform demolition work by entering into an agreement with the school district to recover actual costs incurred.
