Q If a party enters a plea under Section 99-15-26 for DUI, first offense, what fines would the Circuit Court order? And should these be paid to the Circuit Clerk or the clerk of the lower court?

A Under Section 63-11-30, the fine levied for a first offense DUI is not less than $250 nor more than $1000. Since the court is not affirming the verdict of the lower court, and is rendering a new decision, the fines and costs should be paid to the Circuit Clerk. In the event a lower court verdict is upheld, the fines would be paid to the lower court clerk. (Attorney General’s Opinion to Gardner, March 20, 2015)
