Q Our coroner obtains medical records from hospitals and ambulance services in order to conduct his investigation into the death, and law enforcement often requests the medical records he received. Does the coroner have the authority to release medical records of decedents to local law enforcement officers without a subpoena?

A Yes. Pursuant to section 41-61-63, the county coroner has the authority to release medical records to local law enforcement to aid law enforcement in its investigation of a death. (Attorney General’s Opinion to White, August 8, 2014)
