Q May the counties allow the placement of a privately-owned digital messaging board in the sheriff’s office? This would be pursuant to a lease and the private company/owner would sell advertising on the board. The sole purpose of the board would be for the selling of advertisements.

A No. Counties and municipalities have the authority through home rule to engage in advertising through webpages, signs and other media. The principal limitation placed on such advertising activities is that counties and municipalities may not engage in advertising if the primary purpose is to make a profit as opposed to fulfilling some government function.
