Q A member of a community hospital board of trustees pled guilty to one count of tax evasion related to the “Fen-Phen” drug cases. Should she be removed from office?

A No. As a general rule, Section 44 of the Mississippi Constitution disqualifies one convicted of a felony from serving in public office. However, a conviction of a violation of the United States Internal Revenue Code is specifically excepted from that general rule. (Attorney General’s Opinion to Guice, June 27, 2014)
