Q May a municipality enters into a contract with a municipal attorney to include compensation on a salary basis as well as an hourly rate for those areas that fall outside of the base salary?

A The municipality may employ a municipal attorney or, in the alternative, a firm of attorneys to represent the interests of the municipality. The governing authorities of a municipality may prescribe regular compensation or a “base salary” for the municipal attorney for specific services and additional compensation for any legal services and duties performed that are not covered by the regular compensation in accordance with Section 21-15-25.
