Q If a municipal employee becomes intoxicated on the job and the mayor sends him home, must he be paid for the time he is under suspension? If so, may the board retroactively suspend him without pay for the time he was out?

A The mayor has the authority by statute to control the affairs of the municipality and would include the authority to suspend an employee with pay as a proper exercise of that authority. A board may not retroactively apply a suspension without pay to an employee; action taken by the board must be prospective in nature. (Attorney Generalís Opinion to Robbins, May 2, 2014)
