Q Our county has a regional correctional facility, formed pursuant to the authority of Sections 47-5-931 et seq. Does the sheriff have the authority to set salaries and administer raises for the facility employees?

A The sheriff has the authority to set the salaries of his employees, subject to the board of supervisors’ right to approve the overall budget. Once salaries are set, the sheriff cannot unilaterally raise salaries when the money for such raises is not included within the budget approved by the board of supervisors.
