Q Our board of supervisors is creating a county park commission under Section 55-9-81. May we appoint the board members to serve as the park commission?

A No. Where a board of supervisors creates a separate board that exercises core powers of the executive branch, the supervisors cannot serve on that board unless statutes specifically provide otherwise. The park commission exercises executive branch powers, so a member of the board may not serve on the commission and retain his or her seat on the board of supervisors.
