Q May an LLC wholly owned by the financially independent brother (not a city employee) of the newly-elected mayor continue to provide security services as a contractor or subcontractor to the city after the mayor takes office?

A Yes. If the mayor and brother are totally financially independent from each other, and the mayor fully recuses from any action benefitting the LLC or the brother, then no violation of Section 109 of the Mississippi Constitution or of Sections 25-4-105(2) or 25-4-105(1) of the Mississippi Code should arise.
