Q Is real property owned by the Board of Trustees of the Institutions of Higher Learning, which will be leased for 99 years to a private entity in the future, subject to municipal zoning ordinances?

A While the IHL Board of Trustees has been granted general authority to exercise control over IHL property by Section 37-101-15, this does not extend to a nonprofit corporation leasing IHL property under a 99 year lease. The property would thus be subject to reasonable municipal zoning ordinances. (Attorney General’s Opinion to Jacks, June 28, 2013)
