Q What is the proper affidavit/charging document to charge a defendant with a violation of section 63-11-30(12) – DUI Child Endangerment?

A A generic affidavit should be used to charge a person with DUI – Child Endangerment under Section 63-11-30 (12). The Uniform Traffic Ticket – DUI cannot be used, as it is for violation of subsection (1), and subsection (12) specifically states that DUI – Child Endangerment shall not be merged with a violation if subsection (1) DUI. The Uniform Traffic Ticket is not used for a violation if Chapter 11 of Title 63, so it may not be used. (Attorney General’s Opinion to Lawrence, March 8, 2013)
