Q May the municipal utility commission implement a program by which the monthly bills will be rounded to the nearest dollar for those customers who volunteer to do so for the purpose of raising money for municipal projects?

A No. There is no authority to generate a surplus, as the municipal utility system should not be a profit-making venture. Further, previous Opinions have stated that there is no authority for governing authorities of a municipality to include a donation line item on its water bills. Likewise, there is no authority for a municipal utility commission to “round up” its utility bills, whether voluntary or involuntary, to generate funds for municipal projects. Should a citizen wish to make a monetary donation to a municipality, he or she may do so directly to the municipality. (Attorney General’s Opinion to Sanders, January 25, 2013)
